KG represented a major vehicle importing and trading company in a public procurement dispute before the Piraeus Administrative Court of Appeal

KG Law Firm’s Public and Administrative Law Team successfully represented a major vehicle importer before the Piraeus Administrative Court of Appeal. The case involved the annulment of a decision issued by the Hellenic Single Public Procurement Authority (H.S.P.P.A.), which had declared invalid the award of a vehicle public procurement contract valued at €4,5m by the Hellenic Coastguard.

The Court accepted that:

  • The contract awardee was not obliged to declare its partners as subcontractors in the European Single Procurement Document (ESPD), when ensuring the guaranteed operation of the contract, ancillary to the main subject matter of the contract.
  • H.S.P.P.A. was obliged to refer the case to the Awarding Authority, allowing the awarded contractor to rectify any discrepancies related to the award documents certifying the nominalization of its shares.
