We advise the sponsor – ABO WIND A.G. – for the participation of the company via the SPVs holding the Projects’ licenses at the RAE Call for Tenders; we render advice in relation to the Feed in Premium structure, regulatory aspects of the market and have performed an extensive legal due diligence on the PV Assets to be acquired; we have expanded our due diligence on the applicable licensing issues in order to confirm the status thereof.

The project will be constructed since the SPVs have been awarded the tender for the related capacity of a total of 44MWp based on the terms and conditions of the RAE Call for Tenders; in parallel, the parties are concluding SHAs which would allow financing and other related matters to be undertaken by the sponsors before the completion of the transaction. KG performed extensive legal due diligence on the environmental terms applicable on the project and offered comfort on regulatory issues due to the change of control. We also structured conditional SPAs for the acquisition of the SPVs and have signed-off full series of agreements.
