The AI Act entered its final stage of the EU legislative process following approval by the European Parliament (https://shorturl.at/rxMQW).
Among the numerous novelties introduced, the AI Act in its current form is verging towards adoption of the following:
✓ Definition for AI that corresponds with the definition of the OECD
✓ Risk-based approach enabling tiered obligations
✓ Unconditional ban on AI for biometric surveillance, emotion recognition and predictive policing systems, and untargeted scraping of facial images
✓ Setting up of regulatory sandboxes to foster innovation
✓ Supporting innovation through the introduction of exemptions for scientific research and development, as well as for open-source AI components
KG’s Data Protection Practice is closely monitoring the novel legal implications of the first ever AI Act while awaiting to see how the EU trilogue procedure will develop.
