Directive 2019/2161 on better enforcement and modernization of Union consumer protection rules

Directive 2019/2161 on better enforcement and modernisation of Union consumer protection rules (“The Directive”) was adopted by the European Parliament and the Council on the 27th of November 2019 and has entered into force on the 7th of January 2020. EU Member States need to transpose the Directive into national law by November 2021 and apply the measures as of May 2022. The Directive forms part of the ‘New Deal for Consumers’ legislative package proposed by the European Commission in April 2018 that aims to enhance transparency for consumers when buying online, introduces new disclosure obligations for traders and effective penalties and clear rules to tackle the issue of dual quality of products in the EU.
