New Law on Digital Governance and European Electronic Communications Code Transposition in Greece

On 23.09.2020, the Greek Law 4727/2020 “Digital Governance (Transposition to the Greek Legislation of Directive (EU) 2016/2102 and the Directive (EU) 2019/1024) – Electronic Communications (Transposition to the Greek Law of Directive (EU) 2018/1972) and other provisions” was published in the Government Gazette (A’ 184/23.09.2020). Law 4727/2020 incorporates into the Greek legal order, among others, Directive (EU) 2018/1972, establishing the European Electronic Communications Code (“EECC”), as well as Directive (ΕΕ) 2016/2102 on the accessibility of the websites and mobile applications of public sector bodies and Directive (ΕU) 2019/1024 on open data and the re-use of public sector information. The legislation in question reforms and modernizes the telecommunications legal regime in Greece for both services and networks. Among others, it includes provisions on General Authorization, Electronic Communications Networks/Services, Enforcement, Internal Market Procedures, Security, Access to the Market and Development, Universal Service Obligations, Numbering Sources, End-Users’ Rights, etc. Moreover, Law 4727/2020 contains provisions for the digital state, the electronic communication, interactions and transactions with the state through information technology, digital governance, electronic documents and digital public services, open data. Furthermore, Law 4727/2020 includes a chapter on the development of a digital 5G ecosystem deployment in Greece.
